Antis Triantafyllides & Sons LLC successfully secured €1.1 million judgment for breach of settlement agreement and enforcement of contractual liquidated damages clauses
We are pleased to share that our firm successfully represented the claimants in Civil Action No. 1599/15 before the District Court of Nicosia, a case concerning breach of a settlement agreement and the enforcement of contractual liquidated damages clauses.
The proceedings arose from violations of non-compete, non-disparagement and contractual compliance obligations, with the claimants seeking €1.1 million based on agreed predetermined compensation mechanisms.
The Court’s judgment, issued on 23 January 2026, addresses important principles under Cyprus contract law, including the enforceability of agreed compensation clauses, the interpretation of post-termination restrictive covenants and the consequences of commercial bad faith.
This decision provides useful judicial guidance on the operation of liquidated damages provisions in complex cross-border commercial arrangements.
