Antis Triantafyllides & Sons LLC successfully represented an individual against the Cyprus Health Insurance Organisation
Our firm successfully represented a Cypriot individual (the applicant), before the Administrative Court of Cyprus, in his appeal against the decision of the Cyprus Health Insurance Organisation (“HIO”) to refuse the execution of a prescription issued by a non-contracted doctor, despite the fact that the prescribed medications were included in the list of the General Healthcare System (“GESY”).
The Administrative Court, ruling in favour of the applicant, found that the HIO’s interpretation – namely, requiring prescriptions to be issued exclusively by contracted doctors – was incorrect. It ruled that prescriptions from any doctor, regardless of whether they are contracted with the GESY, must be accepted, as long as they are dispensed by a contracted pharmacy.
This decision sets an important precedent for the prescribing and dispensing of prescriptions within the framework of the GESY, recognising the right of beneficiaries to receive medication based on prescriptions issued by non-contracted doctors.
